CONDITIONS OF USE FOR LITIGANTS

INTRODUCTION

These terms of use (the “Terms of Use”) explain the conditions under which you, as a User, may use the legal marketing platform hosted at www.fttsignup.com (the “Platform”).

By submitting a Request via the Platform you become a User and agree to be bound by our Terms of Use. If you do not agree, in whole or in part, with the contents of these Terms of Use, please immediately cease all use of the Platform and notify us by e-mail: www.fttsignup.com

DEFINITIONS

Unless the context otherwise requires, the following words and expressions are defined as follows:

  • “Terms of Use”: This document, together with the Privacy Policy, as amended from time to time;
  • “Request”: Any request submitted by a Litigant via the Platform for the purpose of being put in contact with a Professional;
  • “Litigant”, “User” or “You”: A person accessing the Platform or one of its satellites for the purpose of being connected with one or more Professionals;
  • “We”: FightTrafficTickets.ca, which operates under the name FightTrafficTickets.ca;
  • “Platform”: The legal marketing platform located at www.fttsignup.com;
  • “Privacy Policy”: The document accessible here and forming an integral part of the Terms of Use, as well as any modifications that may be made thereto;
  • “Professional”: A legal professional, duly authorized to practice the profession of lawyer, notary, and/or paralegal (depending on the title declared) within the meaning of the laws and regulations applicable in the territory or territories it serves or wishes to serve, registered or in the process of registering on the Platform for the purpose of being connected with Litigants;

ABOUT US AND OUR PLATFORM

We believe that new technologies now offer the tools to better meet the challenges of access to justice for litigants and business development for professionals.

Our Platform aims to connect the right Litigants with the right Professionals, simply, quickly, and intelligently. For litigants, it’s a search engine providing quicker, easier access to the professionals they need.

However, we do not provide legal services. We are not a firm of lawyers or notaries. Our role is limited solely to acting as an intermediary between Litigants and Professionals for the purpose of putting them in contact. We are therefore in no way responsible for the services rendered, or not rendered, following any introduction via our Platform and make no specific representation or warranty in respect thereof.

We use cookies to facilitate navigation on the Platform and to ensure its proper functioning. For more information on this subject, please consult our Privacy Policy.

UNDERSTANDING, RECOGNITION, AND DECLARATIONS

By submitting a Request, you understand, acknowledge, and declare that, at all times:

  • You are the Litigant you claim to be;
  • Professionals will be put in contact with you on the basis of the information you have posted or communicated to us, in particular by completing your Request, and, consequently, that this information is true and that you have not made any false, misleading, or exaggerated statements;
  • It is possible that no Professional can answer your Request;
  • It’s up to you to manage the urgency of your request, particularly in the case of an imminent prescription;
  • The Platform’s contact with the Professional does not constitute an offer of legal services and does not bind the Professional to any obligation to open a file;
  • You are under no obligation to retain the services of the Professional;
  • During your first contact with a Professional, you’ll want to clarify the question of professional fees quickly to avoid any misunderstandings;
  • You will treat the Professional we connect you with courtesy;
  • FightTrafficTickets.ca is not a law firm and does not provide legal services; and
  • Your relationship with the Professional is between you and the Professional and is totally independent of the Platform.


Finally, you acknowledge that you are solely responsible for retaining or not retaining the services of the Professional, as well as any costs that may be incurred, and this, to our entire exoneration.

LEGAL CONNECTION AND LIMITATION OF LIABILITY

Once you have completed your Request, we will forward it to the Professionals who meet your criteria to facilitate the matchmaking process. Our obligations towards you will be only of means. Thus, our only obligation will be to take the necessary steps to put you in contact with Professionals who are active in our catchment area and who appear to us to meet your criteria, on the basis of what they have declared to us, but we cannot be held responsible if:

  • No Professional responds to your Request;
  • Failure by a Professional to process your Request or respond in time will result in the loss of any right;
  • Professionals do not keep their appointments;
  • The connection does not lead to the opening of your file with the Professional;
  • The Professionals don’t meet your needs or you’re not satisfied with their services;
  • The Professionals commit any fault and/or negligence in the context of the services they may render to you;
  • The Professionals are ultimately found not to be legally entitled to render services to you and/or practice their profession; and
  • You don’t win your case.


You acknowledge that by retaining our services, any of the situations below may occur and that, in such a case, you release us from any liability.

For the sake of clarity, we are not liable for any damages and/or inconveniences, direct or indirect, arising from a Request and/or from the connection or not between the Professionals and you via our intermediary.

ACCESS TO THE PLATFORM AND LIMITATION OF LIABILITY

We may suspend or terminate the Platform at any time at our sole discretion. We do not guarantee in any way that the Platform will be accessible at all times or that its use will be uninterrupted.

You agree that the Platform is provided on an “as is” and “as available” basis. We make no representations or warranties with respect to the Platform, its functionality, or its content, including, without limitation, the completeness, accuracy, and timeliness of the content and any warranty of satisfaction or fitness for a particular purpose, that the Platform will meet your needs and expectations, etc. We will not be liable for any interruptions in service, server failures, technical problems, loss, or theft of data. We cannot be held responsible for service interruptions, server failures, technical problems, loss, or theft of data.

To the extent permitted by law, we assume no liability or responsibility for any errors or inaccuracies in any Content, for the unavailability of the Site for any reason and for any representations or statements made on the Site.

EXEMPTION

You agree and covenant to indemnify and exonerate us from and against any and all damages, costs, claims, suits, liabilities, or actions arising from any property damage and personal injury, including death, resulting in any way from the use of our services or Platform, unless such property damage or personal injury is attributable to our gross negligence or gross negligence, or that of a person under our control and direction.

You release us from all liability for any claims, demands, and damages arising from disputes with any third party as a result of the sale of a document to you.

APPLICABLE LAW AND CHOICE OF DOMICILE

You agree that the Terms of Use shall be governed by and construed in accordance with the laws of the Province of Ontario, that any dispute or cause of action arising therefrom shall originate in the judicial district of Toronto and that only the courts of the judicial district of Toronto shall have jurisdiction to hear any dispute arising directly or indirectly out of the Terms of Use.

MODIFICATIONS

We may make changes to the Terms of Use from time to time. The new version will be published on the Platform. Changes will automatically take effect 60 days after they are published. Your use of the Platform after this 60-day period will constitute your acceptance of the new Terms of Use. It is your responsibility to check the Terms of Use from time to time for any such changes.

GENERAL PROVISIONS

Each provision of the Terms of Use forms a distinct whole, so that any decision by a court to render null and void and unenforceable one of the provisions hereof will not affect the validity or enforceability of the other provisions. Our failure to exercise or enforce any right under the Terms of Use or Privacy Policy shall not constitute a waiver of such right or provision.

The Terms of Use, Privacy Policy, and Service Agreement between you and us constitute the entire agreement between you and us with respect to the use of the Platform and supersede any prior representations, statements, or other communications not contained herein.

You may not assign or otherwise transfer any of your rights under the Terms of Use and Privacy Policy.

PRIVACY POLICY

We will only use your information in the manner described in our Privacy Policy, which is incorporated into and forms part of the Terms of Use. If you do not wish your personal information to be transferred or used as described in our Privacy Policy, please do not use the Platform.

TRANSLATION

In the event of differences of meaning or interpretation between the original English version of the Terms of Use and a translation, the original English version shall prevail.
